Terms of Service

These Terms of Service (“Terms”) govern purchases and use of products and services offered through the SulfurSMP Minecraft server web store (the “Store”), operated by SulfurSMP ownership (“we,” “us,” or “our”).

By accessing the Store, placing an order, or using a product purchased through the Store, you agree to these Terms. If you do not agree, do not use the Store or purchase its products.

1. Eligibility

You must be legally capable of entering into a binding agreement in your jurisdiction to make purchases through the Store. If you are under the applicable age of majority, you may only make a purchase with the involvement and permission of a parent or legal guardian where required by law.

You are responsible for ensuring that purchases made using your payment method are authorized.

2. Store Products

The Store may offer digital products and services for use on SulfurSMP, including, but not limited to:

• Ranks, memberships, or subscriptions;
• In-game currency or virtual items;
• Cosmetic features;
• Access to special areas, commands, or gameplay features; and
• Other digital benefits described on the Store.

All products are digital unless expressly stated otherwise. Product descriptions, prices, availability, and included benefits may change from time to time.

3. Purchases and Payment

All prices are displayed in US Dollars unless otherwise stated.

You agree to provide accurate and complete billing information and to use a payment method that you are authorized to use. Payment processing may be handled by third-party payment providers, whose own terms and privacy policies may also apply.

A purchase is not complete until payment has been successfully authorized and accepted by the Store.

We reserve the right to refuse, cancel, or limit an order where permitted by law, including in cases of suspected fraud, unauthorized transactions, pricing errors, technical errors, or abuse of the Store.

4. Digital Delivery

Digital products are generally delivered automatically to the Minecraft account, player account, or server account associated with the purchase.

Delivery times may vary due to technical issues, payment processing, server maintenance, or other circumstances outside our reasonable control.

You are responsible for providing the correct Minecraft username, account information, or other information necessary to receive your purchase.

5. Virtual Items and Digital Benefits

Virtual currency, ranks, items, cosmetics, permissions, and other digital benefits have no cash value unless applicable law requires otherwise.

Unless expressly stated otherwise, digital products are licensed to you for use within SulfurSMP and are not sold as transferable property.

You may not sell, trade, transfer, reproduce, exploit, or otherwise misuse Store products except where expressly permitted by us or required by law.

We may modify, balance, replace, or discontinue digital benefits where reasonably necessary for the operation of the server, provided that we comply with any rights you may have under applicable law.

6. Server Rules

Use of purchased products remains subject to the SulfurSMP server rules, community guidelines, and other applicable policies.

Purchasing a product does not grant immunity from moderation or disciplinary action. We may suspend, restrict, or remove access to an account or purchased digital benefits when reasonably necessary because of cheating, fraud, abuse, chargebacks, harassment, exploitation, or violation of server rules or these Terms, subject to applicable law.

7. Refunds and Cancellations

Because Store products are primarily digital goods, purchases are generally non-refundable once digital content or benefits have been delivered, except where a refund is required by applicable law or expressly provided by our refund policy.

Nothing in these Terms is intended to exclude or limit any mandatory statutory consumer rights.

Where applicable, refund requests should be submitted through [email protected] and should include the order number, Minecraft username, purchase date, and reason for the request.

We may deny refund requests where permitted by law, including requests involving products that have already been consumed, redeemed, or transferred, or where there is evidence of abuse of the refund process.

8. Chargebacks and Payment Disputes

You agree to contact us before initiating a payment dispute or chargeback when you believe there is a problem with an order, unless applicable law or your payment provider's rules require otherwise.

Fraudulent or unauthorized chargebacks may result in suspension of the associated account and removal of Store benefits, subject to applicable law.

We reserve the right to provide relevant transaction and account information to payment processors or financial institutions when responding to a disputed transaction.

9. Accounts and Security

You are responsible for maintaining the security of your Minecraft account, Store account, and any associated credentials.

You must not impersonate another person, use another person's account without authorization, or provide false information in connection with a purchase.

We are not responsible for losses resulting from your failure to secure your account, except to the extent liability cannot lawfully be excluded.

10. Intellectual Property

The Store, server name, logos, graphics, website content, software, artwork, text, and other materials provided by us are owned by us or our licensors and are protected by applicable intellectual-property laws.

A purchase does not transfer ownership of our intellectual property to you.

You may not copy, redistribute, resell, reverse engineer, modify, or commercially exploit Store materials except where permitted by law or expressly authorized by us.

Minecraft and associated trademarks are owned by their respective owners. SulfurSMP is not affiliated with, endorsed by, or sponsored by Mojang or Microsoft unless expressly stated otherwise.

11. Prohibited Conduct

You may not use the Store or purchased products to:

• Commit fraud or facilitate unauthorized transactions;
• Exploit bugs, vulnerabilities, or payment-system errors;
• Circumvent bans, restrictions, or security measures;
• Resell Store products without authorization;
• Abuse refunds, promotions, or chargebacks;
• Interfere with the Store, server, or other users; or
• Violate applicable laws or regulations.

We may take reasonable action against prohibited conduct, including suspending Store access or removing digital benefits, subject to applicable law.

12. Store Availability

We do not guarantee that the Store or server will be continuously available, uninterrupted, or error-free.

We may temporarily suspend or modify the Store or server for maintenance, security, updates, technical issues, or other operational reasons.

Nothing in these Terms affects any rights you may have concerning unavailable or defective digital content under applicable consumer-protection law.

13. Disclaimers

To the maximum extent permitted by applicable law, the Store and its services are provided without warranties other than warranties that cannot legally be excluded.

We do not guarantee that the server, Store, or purchased benefits will operate without interruption or that they will meet every particular preference or expectation.

14. Limitation of Liability

To the maximum extent permitted by applicable law, we will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the Store or server.

Where legally permitted, our total liability relating to a particular purchase will not exceed the amount you paid for that purchase.

Nothing in these Terms limits or excludes liability that cannot legally be limited or excluded.

15. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless SulfurSMP, its operators, staff, contractors, and affiliates from claims, losses, liabilities, and expenses arising from your unlawful use of the Store, your violation of these Terms, or your misuse of purchased products.

16. Changes to These Terms

We may update these Terms from time to time.

When we make material changes, we may provide notice through the Store, website, server, or other reasonable means. The updated Terms will become effective on the date stated in the revised Terms.

Your continued use of the Store after the effective date of updated Terms constitutes acceptance of the revised Terms to the extent permitted by law.

Payment information may be processed directly by third-party payment providers. We may receive limited transaction information necessary to process orders, provide digital products, prevent fraud, and provide customer support.

18. Third-Party Services

The Store may integrate with third-party services, including payment processors, Minecraft-related services, hosting providers, authentication services, analytics providers, or other vendors.

Your use of third-party services may be subject to their separate terms and policies. We are not responsible for third-party services except where applicable law provides otherwise.

19. Governing Law

These Terms are governed by the laws of European Union, without regard to conflict-of-law principles, except where mandatory consumer-protection laws require the application of another jurisdiction's law.

Any disputes will be handled by the courts or dispute-resolution process having appropriate jurisdiction, subject to any mandatory rights you have under applicable law.

20. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in effect. The invalid provision will be modified or interpreted to the minimum extent necessary to make it enforceable where legally permitted.

21. Entire Agreement

These Terms, together with any applicable Store policies, server rules, refund policy, and privacy policy, constitute the agreement between you and us concerning your use of the Store, except where a separate written agreement applies.
